Marina Information

We've been building a web-based site for boating over the last 14 months. There are a few things that come close to what we've been working on, but nothing that goes as far or as deep. It's called ActiveCaptain (www.activecaptain.com).

ActiveCaptain is not commercial. There is no cost. There are no advertisements. It is designed to be a place where you can find marinas, anchorages, and local knowledge visually on worldwide maps. It should be fast and interactive...and fun.

We've loaded the initial database full of 8,000 marinas in the US. Each entry holds 116 fields broken up into 5 sections and 49 groupings. The database includes common things like phone number, lat/lon, website, etc. but we also track things that aren't often documented - are pets welcome, diesel price/date, internet access, slip price per foot, and many other items. There is also an extensive capability for reviewing and rating a facility. Anchorages and "local knowledge" are much simpler and will be added next.

We need people to review the marine facilities in their area and make additions, corrections, reviews, etc. We need a lot of people.

ActiveCaptain is all about community. The framework will allow others to share their knowledge and experience. Adding the information you know into this framework will help many others and end up helping yourself when you cruise to an area that you are less familiar with.

Most USENET newsgroups have a charter that outlines what is and is not acceptable to post in the group. Unfortunately, rec.boats does not have a charter. So really, there is no such thing as an off topic post in rec.boats. Anything goes.

Now, your ISP probably (most do) have a TOS that spells out a lot of things you can't do. You should check your individual ISP's TOS.

Since I am quoted... I'll try again.... I said, "web based forums." I did not mean, nor did I imply any USENET newsgroup. In fact, I specifically had in mind those (privately held) forums that had TOS and in most cases moderated (censored) content.

Rec.boats was created before charters were deemed necessary and when people acted with a bit more decorum than they do now. It is sad social commentary.

So, you can come here and be as bad as you want to be. Then, the only remaining venue will be a private site where you can go say (only) what the moderator wishes others to see and where you have to adhere to a certain code of behavior or be sued....

How do you enforce acceptable and not acceptable for USENET charters that were written and approved, by vote of the UUNet/Internet masses 20 years ago.

Do you remember the Richard Depew(sp?) incident of the early 90's?

You are correct, I have no idea who is using cancelbots today. I just remember that I was involved in tiff with The Dick about his actions. He said that he had been appointed/approved as a net cop by somebody I can't remember. I asked to see his badge and he said he didn't have one. Bert

You both take usenet far too seriously, but I would suggest that using a "real name" could lead to truly serious complications. Besides the annoyance of additional spam, more than one person has been the victim of identity theft due to online activities. Then there are the even more serious issues, stalkers, pedophiles, etc. Using your real name flies in the face of all online recommendations, and is basically stupid. thunder

Curious that you should bring that up.

I've always felt that nicks are an essential part of Usenet philosophy. It gives you some freedom to be who you are, but it also insulates you personally from, as you say, stalkers, etc. You don't see the great posters of years ago - Gharlane of Eddore, Deacon, James Boe (one of Usenet's Ten Most Wanted), Motar the Imperious, Namtar, modesty forbids me from naming a couple of my own :>) - the list keeps going and too many to list separately. All of them were witty, wrote acerbic laugh out loud funny and always meaningful commentary not only in the groups of their interest, but other groups as well. There were a lot of elite posters who engaged in free debate without rancor, employed no small amount of wordsmithing skills and most eventually became friends - the Code Duello in those Golden Days wasn't personal as much as it was to have a good discussion/argument.

However all that changed and Usenet is now a wasteland of petty and often inconsequential utterings of petty little tyrants who can't stay on point if their life depended on it. And Usenet has been usurped by the blogosphere with the less enlightened and skilled remaining on Usenet diddling on themselves in an orgy of stupid, irrational and often uninformed musings.

Oh well... :>)

Please. The amateur "blogosphere" is a universe of souls who cannot write and insist on demonstrating it at every opportunity. It's no different than usenet, except the posts are longer and sometimes they're illustrated with photos or artwork. There are some good blog sites written and maintained by professional writers and editors, and some of them are readable, but only in small doses.

The problem with many usenet groups is that they have been infested with slime who think they can get away with posting any sort of insult they like because they're "anonymous."

It's funny - My long time good friend Harold Foskett http://www.foskettequipment.com/html/about_us.html has an entire collection of antique machine tools - all of which still work and he can do amazing work with them - some of it I swear you can't do on a CNC machine. He has an original Heald internal grinder - how about that?

Years ago, I bought a Bridgeport from him when I was into restoring IH tractors and trucks. It's an old Bridgeport, but it still does a great job. Not being a machinist by training, I can do some simple stuff with it, but even at it's age, I can't really use all of it's capabilities - it's kind of like a really fancy drill the way I use it. :>)

If any of you are up here, I'd be glad to take you on the Foskett Equipment Tour of IH tractors and trucks - there are some incredible machines in his collection.

Peggie Hall continues to use and post advice to other boating NG's, including non moderated UseNet forums. When Peggie left rec.boats. she was very adamant why she stopped posting in rec.boats. She was tired of the personal inflammatory attacks by one of more (at the time, the most) prolific regulars in rec.boats.

The personal, inflammatory attacks, and the off topic political bickering that was the norm in rec.boats for so many years is reason why most of the professionals left rec.boats.

What you're really building is a commerically viable list of emails for people interested in boating. You should disclose that you must provide an email address and "register" to use your site.

Good luck staying current with the price of fuel at "8000 marinas". You must have a staff of about 20? :-)

Not only must you "register," you must agree to their Terms of Service.

More to the point..... Personally, I will refuse to post content to any site with this sort of Terms of Service. (That is one good thing about USENET.... we may have a few Net-Cops, but no attorneys.)

I don't see any point in assigning rights to *MY* intellectual property over to *ANYBODY*, without a monetary reward. However, if we are talking rights to a book or movie deal, we'll talk....

Additionally, I refuse to indemnify any site, nor will I, for any reason, agree to pay their legal or accounting fees. Regarding assumption of liability, I just don't believe that anything good can result from the use of the term, "without limitation."

If you are curious, the website's Terms of Service can be accessed from the bottom of their home page.

IMHO, if the OP's intent is to create a venue that,".....is not commercial. [with] no cost. [and] no advertisements....." it should be spun entirely away from his corporation and run as a fun, free, and non-commercial site. Then, the disconcerting legalese can be dropped.

The Privacy Policy listed on the ActiveCaptain web site is very explicit about how an email address will be used. Like the Privacy Policy on this site (Google Groups Privacy Notice : http://groups.google.com/intl/en/googlegroups/privacy3.html), we do require that you register to make additions to the site.

Unfortunately, we live in a world with too many lawyers and we need to protect ourselves should someone enter libelous information on our site, as well as protect users from unauthorized access. We are not charging for the use of this site and don't want a frivolous lawsuit.

Our goal is to create something that will be useful for all boaters. If all participants simply offer honest, true information and opinions, we will all benefit.

I am sorry that our web site has upset you. It was certainly not meant to do that. Our intent is to provide a resource for fellow boaters. The web site arose out of our own desire to have access to this sort of information as we have cruised up and down the East Coast.

You are wise in advising potential users to read our Terms of Use page. Everyone should read these documents for every site they access. You may wish to reread the Terms of Service page for this web site (http://groups.google.com/intl/en/googlegroups/terms_of_service3.html) which also requires you to "indemnify" them (Section 13), to provide personal information to register (Section 3) and controls the content (Section 4).

It is unfortunate that in the times we live in we must worry about lawyers. However, as a free web site we really don't want to fight lawsuits. Like Google, who provides this free service, we must attempt to protect ourselves.

The spirit of ActiveCaptain is a place where we can share information and help one another have safer and more fun boating experiences. I hope you will some day take part. Karen
